Upper Arlington DUI Lawyers

Upper Arlington Mayor’s Court prosecutes OVI cases at their mayor’s court, so if you are arrested for an OVI in Upper Arlington by an Upper Arlington police officer and you do not have any prior DUI convictions, your case will be scheduled at this court. Your case will always be on the Thursday following your arrest.

[BLANK_AUDIO] If you are charged with a DUI case in Upper Arlington Ohio, your case will be prosecuted in Upper Arlington Mayor’s Court. Your arraignment or initial court date will be on the Thursday, following your DUI arrest, at 12 PM.

Do I have to appear at my arraignment?

OVI cases in Upper Arlington are filed and scheduled for arraignment within five (5) business days of your arrest. This gives you the time and opportunity to appeal the administrative license suspension. You may not have to attend your initial court date if you hire an experienced Columbus DUI lawyer. At Luftman, Heck & Associates, we frequently attend the arraignment on our clients’ behalf so they do not have to take time off work or make special arrangements. If we represent you at the arraignment, we will enter a not guilty plea on your behalf, address the issue of your driving privileges, and request any police reports and DVDs.

If you’re charged with a DUI in Upper Arlington Mayor’s Court, you will need to appear at your arraignment. Your arraignment will be held on the Thursday following your DUI arrest, at 12 o’clock PM, at the Upper Arlington Municipal Building. Can I get my license back?

There are a few different ways that you might be able to get your license back or obtain some driving privileges. If you hire us to represent you, we will first look at BMV Form 2255 to see if there are any errors on the document. If there are, this could possibly lead to the termination of your driver’s license suspension altogether.

Unfortunately, unlike many other mayor’s courts in the Central Ohio region, Upper Arlington Mayor’s Court does not permit stays of the administrative license suspension. Instead, we will have to negotiate for you to get limited driving privileges that would allow you to drive to and for school, work, and medical purposes. When represented by an attorney, this is not a very difficult process. To apply for limited driving privileges, you will first be forwarded a blank copy of the Upper Arlington limited driving privilege entry to fill out and return to us. We file it on your behalf and if it is granted, you will receive two certified copies. The first form you will be required to keep in your car at all times while driving, and the second form is a copy just in case you lose the first one.

Upper Arlington Mayor’s Court is one of the rare courts, that does not grant a stay of your license suspension. That means that unless there is an issue with that yellow sheet of paper, the BMV form 2255, you received from the Upper Arlington police officer, you will have to wait either 15 days if you took the breath test, or 30 days if you refused to take the breath test, to get your limited driving privileges.

Do I get to see the police reports?

Yes. Once we receive the police reports, we will always make copies to give to you for review. We ask that you take these reports home so you can review them. Once you have had a chance to look them over thoroughly, send us an email with your thoughts. Be sure to take note of any inconsistencies in the report as well as your summary of what happened.

In every Upper Arlington Mayor’s Court DUI case, a police reports an alcohol influence report, and additional police reports will be filed with the prosecutor’s office. Wendy Williams who works with the city of Upper Arlington, is very fast about getting the police reports to us. And as soon as we receive them, you will receive a copy of everything that we receive to review. Why? Because we want you to go and tell us what you agree with, what you disagree with.

If anything is fabricated or exaggerated on that police report, we want to know, because ultimately it will help us in negotiating with Janine Hammad, the prosecutor, to try to get you the best resolution possible. [BLANK_AUDIO]

Is there a DVD of my traffic stop?

All Upper Arlington police cruisers are equipped with a cruiser vehicle system. So long as there aren’t any malfunctioning parts to the system, there will be a DVD of your traffic stop that we can request. This footage is useful since it will show if there are any parts of the report that are exaggerated or if the roadside field sobriety tests were issued to you correctly. Every one of our Columbus DUI attorneys is certified in the administration of field sobriety tests, which means we know what mistakes to look out for and take note of. We will also provide you with a copy of the DVD.

Every Upper Arlington police cruiser is equipped with a CVS or cruiser video system. That means there will be a DVD of your traffic stop. In every Upper Arlington Mayor’s Court DUI case the Columbus Criminal Defense team will file a discovery motion on your behalf with the city prosecutor’s office.

When we receive it you will be mailed a copy of the DVD to review. Why do we want you to go and review this? Because we want to be able to go and point out to you what the errors are that the police officer made. What he or she did right or wrong, and what the evidently issues are in your case.

What outcome can I expect with my Upper Arlington Mayor’s Court DUI case?

If there are issues with the physical evidence in your DUI case, the prosecution may offer a reduction of your charge to a lesser offense. However, this is not guaranteed, and if the prosecution is unwilling to offer a reduction, it may be advantageous to transfer your case. If transferred, your case will go back through the court process at Franklin County Municipal Court.
