Criminal Trespass Charge Dismissed

Posted On: April 14th, 2014

After allegedly committing some damage to a campus gateway bar, a young man in his mid-20s was advised by security that he was not to return to the campus gateway establishments for one year. Later that evening, he was seen in a restaurant in the area. He was asked to leave and would not. He was arrested and charged with criminal trespass. His case was then scheduled for arraignment in Franklin County Municipal Court.

Having never had a criminal conviction before, this young man didn’t want to acquire a criminal record at age 25. He reached out to attorney Ben Luftman and hired the Columbus Criminal Defense team to represent him in his criminal trespass case.

Attorneys with LHA represented our client in his case. After reviewing the facts, it became apparent that there would be some proof issues if the case went to trial. After discussing the evidentiary issues with the prosecutor, the prosecutor agreed to dismiss the case upon our client’s completion of a small amount of community service and payment of court costs.

Our client was more than happy to accept the negotiated offer. He performed the community service and his criminal trespass case was dismissed. The dismissal and subsequent expungement, or sealing of the record, will completely remove the case from his criminal background.
