Daniel J. Sabol

Daniel J. Sabol is a senior associate at Luftman, Heck & Associates, and heads the firm’s criminal and traffic departments.  Mr. Sabol began his legal career with the Franklin County Public Defender, where he quickly earned a reputation as an aggressive defense attorney by trying more cases in Franklin County Municipal Court than most—if not all—other criminal defense attorneys.  While often dealing with difficult cases, Mr. Sabol won the majority of his cases, and has added to that winning record with the trials he has had since joining Luftman, Heck & Associates (LHA).  Mr. Sabol has exclusively practiced criminal and traffic law, with an emphasis on OVI / DUI defense, drug offenses, theft, crimes of violence, and any cases involving search and seizure issues.

Mr. Sabol has practiced in over 25 counties throughout Ohio, representing clients charged with offenses ranging from speeding to aggravated murder. While at LHA, Mr. Sabol has successfully litigated numerous motion hearings and trials, which have resulted in acquittals, favorable plea bargains, dismissals, and appellate rulings that attorneys throughout the state rely upon. Perhaps the greatest testament to Mr. Sabol’s ability is that he has been asked by prosecutors to represent their friends and family when in need.

Mr. Sabol is known throughout Ohio for his work in the area of OVI / DUI defense. He is often asked for advice from attorneys around the state, and he is a frequent speaker at OVI / DUI legal seminars attended by defense attorneys, prosecutors, and judges.  Mr. Sabol was one of the first attorneys in Ohio to cross-examine a representative from the Ohio Department of Health on the new Intoxilyzer 8000 breath test machine. He was also one of the first attorneys in Ohio to successfully have an Intoxilyzer 8000 breath test result suppressed by a judge in a contested motion hearing.  Click here for the relevant article from the Columbus Dispatch.

Mr. Sabol became certified in the administration of Standardized Field Sobriety Tests (SFST’s) by completing the National Highway Traffic Safety Administration (NHTSA) and the International Association of Chiefs of Police (IACP) DWI Detection and Standardized Field Sobriety Testing course.  Mr. Sabol continued his study of SFST administration by completing a 40 hour course to become certified as an instructor in the administration of SFST’s.  Further, Mr. Sabol became certified in the operation of the BAC Datamaster, a common breath testing instrument used throughout Ohio, by completing a supervisor program on breath alcohol testing at the very location where the machines are manufactured.   Mr. Sabol has greater certification and training than many of the police officers on the road.

Mr. Sabol has appeared on television as a featured speaker on the topic of criminal and traffic defense. Additionally, Mr. Sabol recently co-authored a chapter titled, “Proven Strategies to Effectively Assert Your Client’s Fourth Amendment Rights” in The Legality of Search and Seizure in DUI Cases, 2011 ed., a nationally published DUI book to assist defense attorneys across the country in their DUI cases.

Mr. Sabol believes that for the criminal justice system to be legitimate—and for the Government to be justified in infringing upon the liberty of its citizens—a defendant must be afforded a complete and zealous defense that challenges both police conduct and the prosecution’s ability to prove their case.  Mr. Sabol is devoted to defending his clients from government prosecution, and exhibits a great amount of personal pride in representing each and every case.

In his free time, Mr. Sabol enjoys reviewing case law, playing recreational football and softball, and blindly following his favorite Cleveland sports teams.
