Felony Gun Charge Reduced to Minor Misdemeanor

Posted On: March 24th, 2014

After a traffic stop, a young man was charged with the felony gun charge of improper handling of a firearm in a motor vehicle. The improper handling charge is a fourth-degree felony. It is punishable by 6 to 18 months in prison and up to a $5,000 fine. The young man was arrested and taken to jail. He appeared in Franklin County Municipal Court and was then released on bond the next day. A preliminary hearing was set in 10 days.

During that time, the young man looked very hard for a law firm to represent him on the felony gun charge that could impact his entire life. After meeting with attorney Ben Luftman, the Columbus Criminal Defense team was hired to fight for this young man’s future.

Attorneys with LHA represented the young man during his case. After reviewing the police reports and other discovery, we convinced there were legal issues with the felony gun charge. He ended up having a motion hearing before the assigned judge on those issues. Ultimately, the case was set for trial. We prepared to conduct a jury trial on the case. The morning of trial, the prosecutor agreed to lessen the charge to a minor misdemeanor. A minor misdemeanor is punishable by a $150 fine and no probation. It is the lowest criminal offense. It also was an offer too good for our client to pass up and he resolved the case, paid his fine and was quite thankful to our attorneys for fighting successfully on his behalf.
