Misdemeanor Drug Paraphernalia and Drug Abuse Case Dismissed

A young man in his early 20s was headed with a group of friends to pick up another friend. While waiting for him outside in their car, a Westerville police officer approached the vehicle. After some questioning, the police officer searched the group of friends. One of them had marijuana and a pipe. He was then charged with possession of marijuana and drug paraphernalia. His case was scheduled for arraignment in Westerville Mayor’s Court.

The young man was very concerned. Having never been charged with more than a traffic ticket, being charged with a criminal drug offense was not something he wanted on his record. Additionally, he was concerned about the possibility that the marijuana possession and drug paraphernalia charges could keep him from getting financial aid for college.

After speaking with attorney Ben Luftman, the Columbus Criminal Defense team was retained to represent the young man and to try and keep the drug conviction off his record. Attorneys with LHA represented the young man on his marijuana possession and drug paraphernalia case.

After attending a number of court dates at Westerville Mayor’s Court, it became necessary to transfer the case to Franklin County Municipal Court. After two additional court dates in Franklin County Municipal Court, the prosecutor offered to dismiss both of the charges. The dismissal and subsequent expungement or sealing of the marijuana possession and drug paraphernalia case will allow our client to get his financial aid, attend college and will remove the stain of a criminal record from his background.
