Ohio Legal Limit OVI / DUI Consequences Avoided

Posted On: April 15th, 2014

After recently being pulled over for speed by an Ohio State Highway Patrol trooper, a young nurse in her early 30s found herself in a foreign and terrifying situation. The trooper began talking to her about her speeding ticket and the conversation turned to whether she had been drinking. She admitted she had. The trooper then asked her to perform the roadside field sobriety tests. She complied. After completing the tests, the trooper arrested her and charged her with a first offense OVI / DUI.  She was then asked to submit to a urine test to see if her blood alcohol concentration exceeded the Ohio legal limit. She agreed to take the test. She was then given her ticket and her case scheduled for arraignment in Fairfield County Municipal Court.

Being a registered nurse, this young lady was now faced with a number of concerns. She did not know what the result of the urine test would be, or whether she was facing a charge of OVI / DUI for exceeding the Ohio legal limit. She did not know if she would be facing jail time, a long license suspension or probation. She began to research. After researching her options, she found attorney Ben Luftman. After talking about the facts of her case, the registered nurse made the decision to hire attorney Luftman and the Columbus Criminal Defense team to represent her.

While her case was pending, the result came back and was well over the high test Ohio legal limit. The nurse was now facing mandatory jail time, as well as mandatory yellow plates on her car. Given her position, this was not an option. Fortunately, the attorneys with LHA had reviewed and scrutinized all of the police reports and documents surrounding her case. Having found a number of issues with the case and negotiated multiple times with the prosecutor, we were able to convince the prosecutor to not move forward with the OVI / DUI high test urine charge. This resolution ultimately kept our client from going to jail and kept the yellow plated off of her vehicle.
