Second OVI / DUI in Six Years Reduced

A young man was in town one evening and was stopped for a marked lanes violation by an Ohio State Highway Patrol trooper. After performing the roadside field sobriety tests, the young man was arrested. He was asked to submit to a breath test and refused. Unfortunately, he had a prior OVI / DUI conviction within the last six years. He was charged with Second OVI / DUI in Six Years. His license was seized and he was placed under an administrative license suspension. His case was then scheduled for arraignment in Franklin County Municipal Court.

This was an extremely scary situation. This young man, who does not live in the Central Ohio area, was not looking at the potential of 20 days mandatory minimum in jail and a one-to-five year license suspension with mandatory yellow plates and a mandatory breath test device installed in his vehicle. After the hearing, the prosecutor offered to reduce the second OVI / DUI in six years charge to a lesser Reckless Operation offense. The Reckless Operation charge is a non-alcohol related traffic offense. The judge did not impose any jail time or probation.
