Businessman Avoids Theft Conviction

A businessman in his early 60s found himself in an unfortunate situation recently. After shopping at a local Columbus Kroger store, he was checking out with his items. There was an issue while scanning his items and a few of them did not scan properly. He did not know this. While exiting the store, he was stopped by loss prevention. He was then escorted to the loss prevention office, where he was questioned. English is not this gentleman’s first language. He tried to explain the issue and protested his innocence. Loss prevention was not swayed and charged him with a theft charge in Franklin County Municipal Court.

The whole ordeal was extremely hurtful to the gentleman. He is a respected businessman. He exports items. He takes care of his family. He did not intend to steal anything. Knowing all of this, his daughter called attorney Ben Luftman and asked to meet to discuss the theft charge. After an office appointment, the Columbus Criminal Defense team was hired to represent the gentleman and try to right this wrong.

Attorney Luftman and attorney Dan Sabol represented the businessman on his theft case. After reviewing the reports and negotiating with the prosecutor, a dismissal of the theft case without trial was offered in exchange for our client’s agreement to fulfill a few conditions, which he was happy to do. The dismissal, along with the subsequent expungement or sealing of his record will completely remove this stain from his criminal background and ultimately allow him to move on from a very unfortunate incident.
