A strange set of circumstances led to a deputy sheriff knocking on the door of a gentleman’s home and asking if he had marijuana inside. After a back and forth between them, the gentleman was charged with marijuana possession. His case was scheduled for arraignment in Delaware County Municipal Court. This gentleman was quite upset at the circumstances and felt that his rights had been violated. When speaking with attorney Ben Luftman, he made it clear he wanted a lawyer who was going to fight for his rights. He retained the Columbus Criminal Defense team to represent him on the case.
Attorneys with LHA represented the gentleman on his case. We agreed that our client’s rights were likely violated by the deputy and was prepared to litigate the marijuana possession case per our client’s requests. Prior to the suppression hearing, we shared his issues with the prosecutor, who then spoke with the deputy. After speaking with the deputy, the prosecutor agreed to dismiss the marijuana possession charge. Our client left court feeling vindicated.
