National Guardsman Avoids OVI / DUI Conviction and License Suspension

A young man who is a member of the National Guard was stopped by a Franklin County Sheriff’s deputy at approximately 2:30 in the morning for a minor traffic violation.  After noticing an open beer can in the car and smelling alcohol, the deputy forced our client to exit the vehicle and submit to the officer’s OVI / DUI investigation.  While the young man was attempting to perform the Standardized Field Sobriety Tests, he began to think of his career and future with the National Guard.  The anxiety led to a “failing” performance and his subsequent arrest.
