Nurse’s Misdemeanor Theft Charge Dismissed

A young nurse and mother of three enjoyed tanning and frequented a central Ohio tanning salon. While purchasing tanning lotion a mistake was made in the change that was given to her. She realized it well after the fact and unfortunately did not return it to the salon quickly enough. After realizing the mistake, the salon contacted the Westerville Police Department, who then contacted the nurse and spoke with her about the incident. After speaking with the police, the young nurse suddenly found herself charged with misdemeanor theft in Westerville Mayor’s Court.

This series of events put this young nurse, who had a previously spotless record through a range of emotions. The long and the short of it was that she knew she could not afford to be convicted of a misdemeanor theft offense and reached out to attorney Ben Luftman to discuss her options. The prosecuting attorney agreed and rather than litigate the case, he offered to dismiss the misdemeanor theft case upon our client’s payment of court costs.

Our client was more than happy to pay the court costs and resolve her case with a dismissal as quickly as possible and without a trial. The dismissal and subsequent expungement, or sealing of her record will permanently remove the misdemeanor theft case from her criminal background.
