Nurse’s Misdemeanor Theft Charge Dismissed

Posted On: May 5th, 2014

While shopping at a local Meijer’s, a registered nurse found herself in a completely unexpected and very scary position. She had placed a couple of items in the front of her shopping cart and while shopping, put her purse on top of these items. When checking out, she forgot the items were under her purse and was stopped by store security. When questioned, she said that it was simply an accident, but the loss prevention officer did not accept her explanation and charged her with misdemeanor theft. Her case was then scheduled in Franklin County Municipal Court.

The situation was extremely disturbing to this young lady. First, she had not knowingly done anything wrong. Second, being a registered nurse puts her in a position of trust, and a misdemeanor theft conviction on her record is simply unacceptable. It was under these circumstances that she reached out to attorney Ben Luftman. After explaining her situation, she retained the Columbus Criminal Defense team to represent her on the case.

Attorneys with LHA represented her on the case. At a jury trial date, where we were prepared to move forward with trial, the prosecutor agreed to dismiss the case. The dismissal, along with the subsequent expungement or sealing of our client’s record will completely remove this misdemeanor theft charge from her criminal background.
