OVI / DUI Charge Reduced to Reckless Operation

A man who was visiting town from another state was out eating with some friends. On his way home, he was stopped by an Ohio State Highway Patrol trooper for a marked lanes violation.  According to the trooper’s report, he could immediately smell a strong odor of an alcoholic beverage coming from inside the vehicle. When asked how much he had to drink, the driver stated “a few beers.”

The driver was then asked to step out of the vehicle and complied. He was then asked to perform the roadside field sobriety tests. He complied. After performing the field sobriety tests, he was arrested and charged with first offense OVI / DUI.

He was then asked to perform a breath test and refused. He was then placed under an administrative license suspension and driven back to his passenger’s home. His case was scheduled for arraignment in Franklin County Municipal Court.
