A man who was visiting town from another state was out eating with some friends. On his way home, he was stopped by an Ohio State Highway Patrol trooper for a marked lanes violation. According to the trooper’s report, he could immediately smell a strong odor of an alcoholic beverage coming from inside the vehicle. When asked how much he had to drink, the driver stated “a few beers.”
The driver was then asked to step out of the vehicle and complied. He was then asked to perform the roadside field sobriety tests. He complied. After performing the field sobriety tests, he was arrested and charged with first offense OVI / DUI.
He was then asked to perform a breath test and refused. He was then placed under an administrative license suspension and driven back to his passenger’s home. His case was scheduled for arraignment in Franklin County Municipal Court.
Not knowing what to do, this out-of-towner turned to his friends for help in finding the best OVI / DUI attorney to help him try to avoid a conviction. An OVI / DUI conviction would not be helpful in advancing this particular individual’s career. Attorney Dan Sabol was recommended as the man for the job and was hired to help.
The gentleman’s case took eight court dates. A motion hearing to suppress the evidence was conducted. At that hearing all of the evidence concerning the OVI / DUI stop, arrest and field sobriety tests were challenged. The trooper was put on the stand and then cross-examined by Attorney Sabol.
After the motion hearing, the prosecutor offered to amend the charge to a lesser reckless operation offense. A reckless operation charge is a non-alcohol related traffic offense. This was exactly the resolution our client needed.
