Case Dismissal For Man Charged With Breaking Into Car and Misuse of Credit Cards

Posted On: January 12th, 2016

A Delaware man in his 40s was recently charged with breaking into a car and 5th-degree felony misuse of credit cards. The man was quite adamant he was not involved in this crime in any way. Declaring that he was out-of-state at the time of the break-in, he relied on the criminal defense attorneys with LHA to clear his name.

As it turns out, the incident correlated very closely to the types of misconduct our client’s brother was recently involved in and indicted for in another county. Under this observation, we subpoenaed the detective in charge of his brother’s case and brought him into trial. Attempting to demonstrate it was likely his brother who committed this crime, wealso subpoenaed alibi witnesses to show he was not in the state at the time of these events. After presenting this strong evidence to the court, the prosecutor chose to dismiss the case against our client.
