College Student’s Delaware Municipal Court Underage Drinking Charge Dismissed

A young college student was recently at a party with some of her friends and they were playing music a bit too loudly. The police were called and while responding they started questioning the young ladies in attendance. They quickly realized that none of the ladies were of legal age to drink and charged all of them with underage possession of alcohol. Their cases were then scheduled in Delaware Municipal Court.

Both the young lady and her parents were deeply concerned. She was a student and working and had otherwise lived a law abiding life and was now charged with a misdemeanor criminal offense. Through family, they reached out to a local prosecutor for advice. The prosecutor referred them to speak with attorney Ben Luftman. Attorney Luftman entered a not guilty plea on his client’s behalf and at the pre-trial was able to negotiate a dismissal of the case upon his client’s completion of an online class, community service and payment of court costs. Immediately following the dismissal, attorney Luftman filed a motion to seal or expunge the record of the case and thereafter attended the hearing where the judge granted his motion.

The case ultimately took 3 months to be completely removed from his client’s background.
