Our client, a woman in her late fifties was shopping at Cabellas. Through a series of events that amounted to a large misunderstanding, she found herself charged with Theft. Her case was scheduled in Franklin County Municipal Court.
To say these charged affected this woman greatly would be an understatement. She had lived an exemplary life. She had never been charged with anything more than a traffic ticket. She has been married for decades and a good mother and wife. She also described herself as woman of faith, so this particular charge was extremely disturbing to her. Knowing this was nothing more than a scanning error and that the charge is public record, she was desperate for vindication and removal of the charge as quickly as possible.
She did a great deal of research and ultimately contacted attorney Ben Luftman to discuss her case, circumstances and options. Feeling comfortable was important to her and she hired the Columbus Criminal Defense team to represent her on the case.
Attorney Dan Sabol and attorney Chase Mallory represented the client on her case. Reviewing the reports, they made an argument to the prosecutor that this was a misunderstanding and at trial it would be extremely unlikely to get a conviction and due to this, the case needed to be dismissed. The prosecutor agreed with attorney Sabol and Mallory’s arguments and agreed to dismiss the theft charge.
The dismissal and subsequent expungement or sealing of our client’s case will remove it from the Franklin County Municipal Clerk of Court’s website. It will also remove the record from her criminal background. The resolution gave a very shaken woman a great deal of comfort and relief.
