Second Lifetime OVI Charge Amended

We recently helped a 19-year-old man from Portsmouth, Ohio charged with a drug-related OVI after failing his field sobriety test. He was arrested for driving without a license. With this being his second lifetime OVI in the last year, he turned to our firm for help. Among other charges our client had, were a minor misdemeanor for possession of marijuana, 1st degree misdemeanor for driving under suspension and a traffic violation.

After carefully reviewing the facts of the case, attorney Chase Mallory spoke to the officer, prosecutor and the judge. At the suppression hearing the OVI charge was amended to a physical control based on evidentiary issues. The OVI did not end up on his record and all other charges were dismissed.
