Mandatory Jail and Restricted Plates Avoided in Nursing Student’s OVI / DUI High Test Case

A nursing student went to visit some friends recently and while in town was stopped by an officer from a local police department for several small marked lanes violations. When the officer approached the vehicle, he noted that the driver had red and watery eyes. He also noted that she had a very strong odor of an alcoholic beverage coming from her. He asked her if she had been drinking and she admitted to having two beers. He asked her to step out of the vehicle and she complied. He asked her to perform the roadside field sobriety tests and she agreed. After performing the tests, she was arrested and charged with a first offense OVI / DUI.

The arresting officer then took her back to the police station and asked her to take a breath test. She complied and her result was over the .170 High Test Ohio Legal Limit. She was then placed under an administrative license suspension and her license was taken. Her case was then scheduled for arraignment. Being far away from home, this young lady did not know who to turn to for help. She did know that if convicted of the OVI / DUI high test, she would have to go to jail and be required to put yellow plates on her car. This frightened her tremendously. Ultimately, she retained the Columbus Criminal Defense team to help keep her out of jail and the yellow plates off her vehicle.
