A young man was driving in Dublin one recent evening and was pulled over by a Dublin Police Department Officer for a traffic control device violation. After coming up to the car, the police officer noticed an odor of alcohol and asked the driver if he had been drinking. He admitted he had. The officer then asked the young man to step out of his car to perform the roadside field sobriety tests. The young man complied. After taking the tests, the officer arrested the driver and charged him with first offense OVI / DUI.
He was then asked to go back to the Dublin Police department and take a breath test. He again complied. The result of the breath test was above the .17 high test legal limit. He was charged with an addition OVI /DUI high test offense. He was also placed under a 90 day administrative license suspension. His case was then scheduled for arraignment in Dublin Mayor’s Court.
The young man was scared. If convicted, he was facing mandatory jail time, as well as mandatory yellow plates on his car. He called attorney Ben Luftman and after their conversation, the Columbus Criminal Defense team was hired to represent him on the case.
Initially, attorney Luftman went to court as was able to secure our client limited driving privileges. The privileges allowed our client to keep his job. Thereafter attorney Dan Sabol transferred the case to Franklin County Municipal Court. After eight court dates, attorney Sabol was able to negotiate the dismissal of the OVI / DUI high test charge. The dismissal saved our client from mandatory jail time and the mandatory yellow plates on his vehicle. For this, he was extremely grateful.
