A businesswoman in her 30s was pulled over by a Dublin Police Department officer and after performing the roadside field sobriety tests, she was charged with a first offense OVI / DUI. She was asked if she would like to take the breath test. She refused. Her license was then taken by the officer and she was placed under a one year administrative license suspension. Her case was then scheduled for arraignment in Dublin Mayor’s Court.
She was terrified. Having never been charged with more than a minor traffic violation, this came as quite a shock. She had no license and no driving privileges. Ultimately, there were not many legal issues to leverage on her behalf. Sometimes that is the case. Nonetheless, attorneys Luftman and Sabol successfully negotiated a reduction of the charge to a lesser reckless operation charge. The reckless operation charge is a non-alcohol related offense. This was precisely the resolution our client was hoping for and she gladly accepted the plea and resolved her case. She was given a fine and no probation and was able to put a very bad evening behind her and move on with her life.
