Upper Arlington DUI Lawyers

Upper Arlington Mayor’s Court prosecutes OVI cases at their mayor’s court, so if you are arrested for an OVI in Upper Arlington by an Upper Arlington police officer and you do not have any prior DUI convictions, your case will be scheduled at this court. Your case will always be on the Thursday following your arrest.

Do I have to appear at my arraignment?

OVI cases in Upper Arlington are filed and scheduled for arraignment within five (5) business days of your arrest. This gives you the time and opportunity to appeal the administrative license suspension. You may not have to attend your initial court date if you hire an experienced Columbus DUI lawyer. If we represent you at the arraignment, we will enter a not guilty plea on your behalf, address the issue of your driving privileges, and request any police reports and DVDs.

Can I get my license back?

There are a few different ways that you might be able to get your license back or obtain some driving privileges. If you hire us to represent you, we will first look at BMV Form 2255 to see if there are any errors on the document. If there are, this could possibly lead to the termination of your driver’s license suspension altogether.

Unfortunately, unlike many other mayor’s courts in the Central Ohio region, Upper Arlington Mayor’s Court does not permit stays of the administrative license suspension. Instead, we will have to negotiate for you to get limited driving privileges that would allow you to drive to and for school, work, and medical purposes. When represented by an attorney, this is not a very difficult process. To apply for limited driving privileges, you will first be forwarded a blank copy of the Upper Arlington limited driving privilege entry to fill out and return to us. We file it on your behalf and if it is granted, you will receive two certified copies. The first form you will be required to keep in your car at all times while driving, and the second form is a copy just in case you lose the first one.

Do I get to see the police reports?

Yes. Once we receive the police reports, we will always make copies to give to you for review. We ask that you take these reports home so you can review them. Once you have had a chance to look them over thoroughly, send us an email with your thoughts. Be sure to take note of any inconsistencies in the report as well as your summary of what happened.

Is there a DVD of my traffic stop?

All Upper Arlington police cruisers are equipped with a cruiser vehicle system. So long as there aren’t any malfunctioning parts to the system, there will be a DVD of your traffic stop that we can request. This footage is useful since it will show if there are any parts of the report that are exaggerated or if the roadside field sobriety tests were issued to you correctly. What outcome can I expect with my Upper Arlington Mayor’s Court DUI case?

If there are issues with the physical evidence in your DUI case, the prosecution may offer a reduction of your charge to a lesser offense. However, this is not guaranteed, and if the prosecution is unwilling to offer a reduction, it may be advantageous to transfer your case. If transferred, your case will go back through the court process at Franklin County Municipal Court.
